The applicant is arrested on 10th May, 2016 in crime registered against him for the offence punishable under Sections 302 of the Indian Penal Code. As per the Investigating Agency, the applicant assaulted deceased Avinash by an axe and the injury is below right knee of the deceased. The applicant claims to be an agricultural labourer. According to the applicant, he is not involved in any other crime/ offence. The Investigating Agency has not controverted this fact.

Chargesheet is filed on 2nd August, 2016. The Investigating Agency has not been able to point out that the custody of the applicant is required for further investigation. In the above facts, I am of the view that the applicant is entitled to be released on bail. Hence, the following order:

The applicant having been arrested in Crime

2 ba204.17 No.131 of 2016, registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.Twenty Thousand and two solvent sureties in the like amount. The applicant shall attend the sessions trial on every date unless granted exemption by the Sessions Court. The application is allowed in the above terms. JUDGE RRaut..
