NO. 64/2023 IN WRIT PETITION NO. 93/2020 CORAM : REGISTRAR (JUDICIAL) DATED : 08/03/2023 The civil application is filed under Order V Rule 20 of the C.P.C., 1908 for subsituted service upon R.No. 1(C) by way of paper publication. It is averred that, as per the bailiff's report, the R.No. 1(C) is not residing on the given address. It is stated in the application that the address given in the petition is same as the address mentioned in Lower Court proceedings. The petitioner further states that there is no other address except present one mentioned in the writ petition.

Hence, considering the reasons mentioned in the application and the bailiff's report, the applicant is allowed to serve aforesaid respondent by substituted service on the last known address by paper publication.

Substituted service be effected upon aforesaid R.No. 1(C) by publishing a notice in widely circulated local daily newspaper "Dainik Bhaskar" Nagpur Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within four weeks from the date of publication of notice.
