DATE : 21 FEBRUARY 2022 The Petitioner is challenging the communication issued by the Respondent-Bank thereby rejecting the Application for compassionate appointment. The impugned order is passed on 6 February 2013, which in turns refers to earlier rejection dated 5 May 2012. The only reason given for approaching this Court after a decade is that the Petitioner is from a remote area and did not have legal advice.

02] Keeping in mind the object for which the compassionate appointments are granted, the delay in approaching this Court becomes more relevant. The legal position has been repeatedly stressed upon through the various decisions, by the

14.wp.2741.20 2 / 2 Hon'ble Supreme Court that in the matters of compassionate appointments, which are for providing immediate relief to the bereaved family of the deceased employee, the stale claims cannot be put forth and the Court should not direct appointments overlooking the aspect of delay and laches. Reasons given for delay are also far too general and cannot justify the delay of more than 10 years.

03] The Writ Petition is, accordingly, rejected.
