DATE : JUNE 09, 2017 This is an application filed by the claimantsrespondent nos.1 and 2 seeking withdrawal of an amount of Rs.25,78,082/- deposited by the appellant in the court towards the decreetal amount.

In view of the submission of the learned counsel for the appellant, since there is a three fold increase made by the reference court in the amount of compensation awarded by the Special Land Acquisition Officer, claimants are permitted to withdraw the amount of Rs.20,00,000/- on furnishing usual undertaking that they will return the amount with interest if the decision goes against them. An amount of Rs.5,00,000/- be kept in fixed deposit in any nationalized bank for the period of 37 months or till the decision of the appeal. Application is disposed of accordingly.
