This writ petition was listed before this Court on 03.01.2019, when the following order was passed:- "

None for the petitioner.

It is interesting to note that when this Court issued notice on 16.03.2017, none had appeared on behalf of the petitioner.

Hence, list this writ petition for further consideration on 09.01.2019, as a matter of last chance."

Even today when the writ petition was called out, none has appeared on behalf of the petitioner. The learned counsel appearing for the respondent no.4 has pointed out that a second appeal filed on behalf of the petitioner herein concerning a suit pertaining to the land in question was dismissed by this Court on 09.02.2018. A copy of the judgment in the Second Appeal No.185 of 2001 is handed over by the learned counsel appearing for the respondent no.4. The said judgment shows that

WP1700-16.odt the petitioner herein i.e. Mohd. Faim Qureshi had died and he was being represented by his legal heir. 3.

Therefore, it appears that the petitioner in the present case is no more and the counsel has chosen not to appear repeatedly before this Court. In these circumstances, this writ petition is dismissed for want of prosecution.
