DATE : APRIL 10, 2015 Prayer is to condone delay in filing the First Appeal. It is submitted that in some what similar circumstances, this Court by order dated 22/10/2013 had condoned the delay of same extent.
Application is opposed by the learned counsel for nonapplicant No.2 on the ground that reasons assigned are not sufficient. It is however not disputed that similar orders were passed in C.A.F. No.676 of 2013.
In view of the reasons mentioned and the order dated 22/10/2013 in C.A.F. No.676 of 2013, delay in filing the First Appeal stands condoned. However, same is subject to the applicant not claiming interest for the period from 02/03/2012 till date. C.A. is allowed and disposed of. F.A. (ST) No.4543 of 2015 Heard.
