Heard Advocate Shri Tathod for the applicant. He has submitted that after lodging the report by one colleague of the applicant. Complainant lodged the report against applicant and others. On the report of complainant offence punishable under sections 326, 324, 504, 143, 147, 148, 149 of the IPC are registered. Learned counsel has submitted that only to the counter report of colleague lodged by the complainant. The complainant lodged the false report. Hence, he is entitled for protection. Perused the report lodged by the complainant and applicant. On the report of colleague of applicant offence punishable under section 324 and 504 read with section 34 of IPC are registered against the complainant and others. Section 149 of IPC shows that the applicant more with than five persons beat the complainant. From the perusal of report it appears that severe injuries were caused on the
aba110.19.O.odt head of the complainant. Therefore, he was admitted in the hospital. After the discharge he came to the Police Station and lodged the report. Therefore, delay of lodging report cannot be a ground to grant anticipatory bail. Weapon of the offence is to be recovered by the Investigating Agency. Hence, the applicant is not entitled for any protection. Application is rejected.
