DATED :- 11/02/2021 The impugned order passed by the learned Sessions Court, Warora below Exh.21, wherein the applicants sought recall of the witnesses for further cross-examination during the pendency of the appeal. The Sessions Court was pleased to reject the said application.

After arguing for some time, the learned Advocate for the applicant seeks permission to withdraw this application and he states that he would contest the matter before the learned Appellate Court seeking remand of the matter to the Trial Court. Application is allowed to be withdrawn and disposed of accordingly, with liberty as prayed for.
