The learned Counsel for the applicant submits that in fact the appeal is within limitation. However, since the office has raised the objection, this civil application for condonation of delay has been filed. He further submitted that there is a delay of 38 days caused in filing the first appeal.

Having heard the learned Counsel for the applicant and having gone through the contents of the application, I think that the delay needs to be condoned. Hence, the civil application for condonation of delay is allowed. The delay caused is condoned.

FIRST APPEAL ST. NO.20855/2017 Issue notice for final disposal of the matter, returnable on 27/11/2018.
