By this petition, the petitioner challenges the termination order dated 15.12.2011 as also the order cancelling the approval to his appointment, dated 12.12.2011. The petitioner also seeks a direction that the order of approval may be corrected. Shri Khubalkar, the learned counsel for the respondent no.3, has raised a preliminary objection to the tenability of the writ petition on the ground of availability of alternate remedy. It is stated that the petitioner has an alternate remedy of approaching the University and College Tribunal under Section 59 of the Maharashtra Universities Act, 1994.

Mrs. Sirpurkar, the learned counsel for the petitioner, states that the petitioner would approach the University and College Tribunal to challenge the impugned orders and in this background, the petitioner may be permitted to withdraw the writ petition.

Permission to withdraw the writ petition is granted. The writ petition is disposed of as withdrawn. The points raised in the petition are kept open. JUDGE JUDGE APTE
