By this writ petition, the petitioners challenge the advertisement/proclamation issued by the Sub-divisional officer inviting applications for the appointment on the post of the Police Patil in Chimur Taluka.

Shri N.R. Rode, the learned Assistant Government Pleader appearing on behalf of the respondents raises a preliminary objection to the tenability of the writ petition. It is stated that the petitioners could have filed an original application before the Maharashtra Administrative Tribunal. It is further stated that the petitioners have participated in the selection process and are then challenging the proclamation. It is stated that after participating in the selection process, a candidate cannot be permitted to challenge the process.

We uphold the preliminary objection raised on behalf of the respondents in respect of the alternate remedy,

wp1580.16 2/2 at this stage. We decline to entertain the writ petition in view of the existence of the alternate remedy of filing an original application before the Tribunal.

The writ petition is disposed of with no order as to costs.
