Non-applicant No.1 has filed this application for modification of the order dated 17th February 2021 seeking direction against the original applicants to deposit an amount of Rupees Twenty Thousand in the office of the Government Pleader, Bombay High Court, Bench at Nagpur for library purpose.

By the order dated 17th February 2021 this Court directed the applicants to deposit the amount to the office of the Government Pleader, Nagpur Bench, Nagpur. It is stated that considering the rationale behind passing of the order it was necessary that the said amount was directed to be deposited with the office of the Government Pleader, Nagpur Bench for the purposes of Library.

The reason behind passing of the order dated 17th February 2021 was to support the office of the Government Pleader in establishing full-fledged Video Conferencing facility so that it would be convenient for the Government Pleader and Assistant Government Pleaders to take instructions from the officers at distant places, specially taking into consideration the COVID-19 situation in the area of operation of Nagpur Bench of the Bombay High Court .

Keeping in view the reason behind passing of the order, we are satisfied that the order dated 17th February 2021 needs to be modified to the extent of specifying the account and the manner in which the purchase is to be made by the office of the Government Pleader.

We, therefore, pass the following order:

i) The order dated 17th February 2021 is modified to the extent that the amount of Rupees Twenty Thousand deposited in pursuance of the order dated 12th February 2021 with the Registry of this Court shall be transferred to the following account of the Government Pleader at Nagpur: Saving Bank A/c. No.: 129710100025875 Name of Bank : Union Bank, High Court Branch, Nagpur.

IFSC Code :UBIN0812978 Beneficiary :M/s. Library Committee, Government Pleader, High Court, Nagpur ii) The office of Government Pleader shall set-up a Committee consisting of two members:

1) The Government Pleader/ In-charge Government Pleader.

2) The Joint Secretary, Law & Judiciary Department, Nagpur.

The aforesaid Committee shall make necessary purchases for installation of the Video Conferencing Facility in the office of Government Pleader, High Court of Bombay, Nagpur Bench, Nagpur.

3 appp445.21.odt iii) It is clarified that the Committee need not have to follow the regular procedure for purchasing the goods as per the Central Scheduled Rates. The Committee shall ensure independent transparent procedure for purchasing of the equipment/ installations for Video Conferencing facility so that the cost of installation is minimized.

With the above clarification the application stands disposed of.
