By this writ petition, the petitioner seeks a direction to the respondent no.3 to protect the education of the petitioner till the caste claim is decided. The petitioner seeks a direction to the respondent no.1-Scrutiny Committee to decide the caste claim of the petitioner as early as possible. According to the petitioner, the caste claim of the petitioner is pending with the Scrutiny Committee and the Scrutiny Committee has not decided the same till date. It is stated that it is most likely that the respondent no.3-College would disturb the education of the petitioner in the absence of the caste validity certificate.

Mrs.Deshpande, the learned Assistant Government Pleader appearing on behalf of the respondent no.1-Committee, states on instructions that the petitioner has supplied necessary documents to the Scrutiny Committee on 15.02.2016 and the caste claim of the petitioner could be decided within a period of six months.

WP1584-16 By accepting the statement made by the learned Assistant Government Pleader, which would be binding on the Scrutiny Committee, we dispose of the writ petition after directing the respondent no.3 to protect the education of the petitioner till his caste claim is decided. This would mean that the petitioner should be permitted to attend the classes, prosecute the studies and appear at the examination, if there is no other impediment in doing so.

Order accordingly. No costs.
