Considering the age of the appellant, nature of the injuries, the fact that the appellant was not involved in any crime earlier, also the fact that the appellant was on bail during the trial and nothing adverse was reported against him, in my view, the sentence is required to be suspended. Hence, the following order :
2 apeal74.16 The sentence imposed by the learned Additional Sessions Judge by the judgment given in Sessions Trial No. 341 of 2013 on 29th January, 2016 on the appellant is suspended during pendency of the appeal.
If the custody of the appellant is not required in any other case, the appellant be released on bail on the same terms and conditions on which he was released by the trial Court.
The Criminal Application is allowed in the above terms.
