This application for speaking to minutes seeks liberty to prefer an appropriate application. The backdrop is that the applicant preferred an application under Section 482 of the Code of Criminal Procedure, 1973 (Code) challenging the order dated 28-2-2020 rendered by the Sessions Judge whereby the bail granted is cancelled. The said application was withdrawn without seeking liberty as is noted in the order dated 15-12-2020.

The question of granting liberty to the applicant, to prefer an appropriate application, cannot be determined in the present application. If, and when, such an application is preferred, it would be for the appropriate Bench to consider whether a case is made out for preferring the application, notwithstanding the withdrawal of the earlier application under Section 482 of the Code.
