DATED : 07-10-2016 In response to the notice issued by this Court, the non-applicant has filed submissions on solemn affirmation stating that he does not wish to continue with the H.M.P. No.A-548/2014 filed by him at Nagpur. In view of this submission, the present application seeking transfer of H.M.P. No.A-548/2014 from Nagpur to Gondia is rendered infrucutous. It is disposed accordingly.

If H.M.P. No.A-548/2014 is not withdrawn by the non-applicant on the next date, the applicant will be at liberty to revive this application and also to seek exemplary costs from the non-applicant.

With the above observations, the miscellaneous civil application is disposed. No costs.
