The learned counsel for the applicant seeks permission to withdraw the instant Application with liberty to approach the trial court afresh as, according to him, there is a subsequent development in the matter. The development is that the learned Sessions Court vide judgment and order order dated 10.02.2023 in Criminal Appeal No.23/2023 has held that the adoption of child was valid and, accordingly, has directed the Child Welfare Committee, Nagpur to hand over the custody of the child to the adoptive parents (original accused nos. 4 & 5).

Permission is granted. The Application is disposed of as withdrawn, with liberty as prayed for.
