Heard.

The applicants, apprehending arrest in crime registered against them for the offences punishable under Sections 65(a) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, have sought pre-arrest bail. According to the Investigating Agency, the wife of applicant No.1 is having country liquor licence and both the applicants are looking after the business under the nokarnama executed by the wife of applicant No.1. According to the Investigating Agency, country liquor worth Rs.19,60,000/- is seized from a vehicle "Bolero", while it was being transported to Chandrapur where sale of liquor is prohibited. The Investigating Agency has pointed out that there are about nine other crimes registered against applicant No.1 and there is ample material on record to show the involvement of applicant No.1 in the crime. As far as applicant No.2 is concerned, he is not involved in any other crime / offence.

2 aba134.17 Considering the facts of the case and the nature of the accusations against the applicants, following order is passed:

The application of applicant No.1 - Arvind S/o Vasantrao Thakre is dismissed.

As far as applicant No.2 - Dilip S/o Ramaji Pawade is concerned, it is directed that in the event of arrest in Crime No.220 of 2017 registered by the non-applicant, he be released on bail on furnishing cash security of Rs.1,00,000/- and one solvent surety in the like amount. The application is disposed of in the above terms. JUDGE PB Patil.
