The issue canvassed by Shri P.N. Shende, learned counsel appearing for the petitioner, in regard to the case of the petitioner being covered by Old Pension Scheme is dealt with by the Full Bench of this Court in its judgment in the case of Deshmukh Dilipkumar Bhagwan and others Versus State of Maharashtra and others, reported in 2019(3) Mh.L.J. 903. 2.

In the aforesaid background, the alternate contention of the counsel for the petitioner is that the petitioner, who was superannuated in 2016, is entitled to receive the benefits of the Contributory Pension Scheme needs to be considered.

Shri Gopal Mishra, learned counsel for the respondent No.3Education Officer; and Shri V.N. Patre, learned counsel for the respondent Nos.4 and 5- Management, assure that said request of the petitioner shall be processed and attended within eight weeks from today. Statement is accepted.

In view of the aforesaid statement made by the learned counsel for the respondent Nos.3, 4 and 5, nothing remains to be considered in this petition and the same stands disposed of.
