In the present Appeal the impugned order dated 01.03.2013 is passed by the 11th Joint Civil Judge, Junior Division and J.M.F.C. Special Court (Section 138 N.I.Act), Nagpur wherein the complaint of the appellant filed under Section 138 of the Negotiable Instruments Act is dismissed and the accused is acquitted for the aforesaid offence, vide Section 256[1] of the Code of Criminal Procedure.

Order 0311apeal97.14 registered] contending that the appellant is a physically disabled person and not interested in prosecuting the present appeal, and accordingly he wants to withdraw the same. She further submits that this Court may grant permission to the appellant to withdraw the present appeal.

Considering the dispute between the parties, I am inclined to permit the appellant to withdraw the present appeal. Accordingly Criminal Application is allowed and appeal is disposed of as withdrawn. Office to register the application. JUDGE Rgd.
