Heard Shri Mir Nagman Ali, learned counsel for the applicant and Shri R.S. Nayak, learned APP for the respondent.

Prima facie, perusal of F.I.R. reveals identification of both the accused by the victim. The argument that even as per story of the prosecution, no active role is played by the present applicant, needs to be appreciated at the stage of final hearing. The material on record establishes and also supports presence with the accused, who has indulged in the act, as per prosecution story.

Hence, no case is made out for grant of bail at this stage. Application rejected.

However, as the applicant Sunil Raju Jadhao was on bail during the pendency of trial, we expedite the hearing of the appeal. After the preparation of paper book, Appeal be listed for final hearing.
