(appointed) for the petitioner. Mr.R.S.Nayak, APP for the respondents.

CORAM : B.P.DHARMADHIKARI AND P.N.DESHMUKH, JJ.

DATED : JUNE 09, 2015.

Heard respective counsel.

Perused the record.

Request of petitioner for release on parole on the ground of illness of his mother has been rejected on 17th of January, 2015. Reasons recorded are that illness is not of serious nature and earlier when he was released he kept away for about 172 days and surrendered belatedly.

Perusal of medical Certificate dated 30th of October, 2014 shows that mother was advised bed rest for sixty days i.e. up to 30th of December, 2014. Her condition thereafter is not on record. The record produced along with reply reveals that petitioner has reported twice belatedly.

In this situation, we do not find impugned order to be perverse. No case is made out to warrant interference at this point of time.

Criminal Writ Petition is accordingly rejected. Charges of counsel (appointed) fixed at Rs.1500/-. JUDGE JUDGE Chute.
