Present application is filed for grant of permission to amend the application. While filing the complaint under Section 494 of the Indian Penal Code, all the family members are made accused, inadvertently those accused persons are not made party. The applicant has filed this application to transfer the said proceedings from learned Civil Judge Junior Division and JMFC Court Deori, District Gondia to learned Chief Judicial Magistrate, Nagpur. As the family members are party in proceeding before JMFC Court, Deori. Though learned Counsel for non-applicant opposed the application, the application is allowed.
