Operative order (i) Criminal Appeal is partly allowed.

(ii) Conviction of appellant under Section 302 of the Indian Penal Code recorded by learned Additional Sessions Judge, Chandrapur in Sessions Case No.48/2002 on 03.01.2020 is hereby quashed and set aside and appellant is acquitted of charge under Section 302 of Indian Penal Code.

(iii) Conviction of appellant under Section 382 of the Indian Penal Code is hereby maintained.

(iv) If the appellant has already undergone the sentence imposed on him under Section 382 of the Indian Penal Code, he be released forthwith, if not required in any other case.

(v) Appellant to execute bail bond under Section 437A of Code of Criminal Procedure.
