The terminated employee, who has failed before the School Tribunal, and who is assailing the judgment dated 25.06.2009 in the present petition, is seeking to bring on the record the subsequent event of his acquittal in the Criminal Trial.

While the learned Counsel for the respondents would submit that the acquittal has no bearing in the departmental action, it would not be necessary to make any observation to the merits of the amendment. The question is left open, to be decided at an appropriate stage. 3.

The application seeking amendment, is allowed. Amendment be carried out within the next week, failing which the petitioner shall deposit costs of Rs.3,000/- (Rupees Three Thousand only) with the High Court Legal Services Sub-Committee, Nagpur.
