This Court appointed Shri C.P. Sen, former Judge of Madhya Pradesh High Court as Arbitrator by the judgment dated 22nd January, 2016. The learned Arbitrator has sent the communication dated 2nd July, 2016 expressing his inability to conduct the arbitration proceedings. The learned Advocates for the parties jointly submit that Shri S.R. Dongaonkar, former Judge of this Court be appointed as Arbitrator, after terminating the mandate of the earlier Arbitrator.

Hence, the following order:

(i) In place of Shri C.P. Sen, the earlier Arbitrator, Shri S.R. Dongaonkar, former Judge of this Court is appointed as Arbitrator to resolve the dispute between the

(ii) The terms as incorporated in the judgment dated 22nd January, 2016 shall remain same.
