DATED : 8th August, 2016 Leave is granted to join the Pay Anomaly Committee of the Nagpur Municipal Corporation as a party- respondent. The amendment should be carried out forthwith.

Learned counsel Shri S.M.Puranik, waives notice on behalf of the newly added-respondent.

By this petition, the petitioner seeks a direction to the respondent no.1 Corporation to apply the pay-scale of Rs. 10,000 -15,200 to the Reporters in Nagpur Municipal Corporation, by implementing the Vth Pay Commission's recommendations and further apply the pay scale of Rs. 15,600 - 39,100 to them by implementing the VIth Pay Commission's recommendations.

Shri S.M.Puranik, the learned counsel for the respondent Corporation states on the basis of a Circular that appears to

have been signed by the Assistant Commissioner (GAD) and Additional Municipal Commissioner (GAD) that the relief could be granted to the petitioner only if it is recommended by the Pay Anomaly Committee comprising of the Hon'ble Additional Municipal Commissioner and the Chief Accountant and Finance Officer of the Nagpur Municipal Corporation. It is stated that the matter would be placed before the Pay Anomaly Committee for scrutiny and for the decision. It is stated that the Pay Anomaly Committee would consider the claim of the petitioner within a reasonable time. The communication - Circular that appears to have been signed on 1.8.2016, is placed on record.

By accepting the statement made on behalf of the respondent-Corporation, we dispose of the Writ Petition by directing the Corporation to place the matter in respect of grant of higher pay scale to the Reporters under the Nagpur Municipal Corporation before the Pay Anomaly Committee within two weeks. We further direct the Pay Anomaly Committee to decide the issue as early as possible and positively within four months from the date of receipt of the same. The petitioner is free to tender the representation/submission to the Corporation within one week.

Order accordingly. No costs.
