The petitioner has approached this Court for a limited relief. It is the contention of the petitioner that though the issues are framed in the year 2012 and though the evidence of the plaintiff/petitioner on preliminary issue is complete long back, the same is not being decided by the learned trial Court and the defendants are protracting the proceedings in the matter.

Since no order prejudicial to the interests of respondents is being passed, the requirement of notice to respondents is waived.

Taking into consideration the innocuous nature of the prayer, we dispose of the petition with a direction to the learned trial Judge to decide the preliminary issue as expeditiously as possible and in any case within a period of six months from today.
