Admittedly, the alleged incident took place on 05.08.2013. Mr. Sharma, learned counsel for the petitioners, further vehemently submitted that the FIR was lodged immediately. Though assault was made by 18 persons with deadly weapons, the police did not register the First Information Report. He then submitted that he made three representations to the police, but to no use.

Upon perusal of the record and upon hearing learned counsel for the parties, we find that the matter has become stale by efflux of time. It would be appropriate for the petitioner to take up the remedy of filing private complaint case under Section

crwp218.15 200 of the Code of Criminal Procedure, which, in our opinion, would be a better course.

That being so, we make the following order.

ORDER

(i) Criminal Writ Petition No. 218/2015 is disposed of reserving liberty in favour of the petitioners to take such other remedy as is available in law, including filing of the private complaint case. JUDGE JUDGE kahale
