DATE : 17.3.2016 Heard Shri U.J. Deshpande, advocate for the applicant and Shri N.B. Jawade, A.P.P. for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him by the non-applicant for the offence punishable under Section 498-A, 306 and 109 of the Indian Penal Code.
The marriage between the applicant and deceased had taken place in 2005 and the incident has taken place on 30 th January, 2016.
2 aba124.16 Considering the nature of accusations, the facts on the record and accepting the statement made on behalf of the applicant that he is not involved in any crime earlier, in my view, the interim order granted by this Court on 2 nd March, 2016 is required to be confirmed, however, on certain conditions.
Hence, the following order:
(i) In the event of arrest of applicant in Crime No.19/2016 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.25,000/- (Rs. Twenty Five Thousand Only) and one solvent surety in the like amount.
(ii) The applicant shall attend the police station Hiwarkhed, Tq. Telhara, Distt. Akola on every Wednesday between 11 a.m. to 1 p.m. till the charge-sheet is filed.
(iii) The application is allowed in the above terms. JUDGE Tambaskar.
