Heard learned counsel Shri M.V.Rai for applicants and learned Additional Public Prosecutor Shri S.S.Doifode for non-applicant No.1/State. Learned counsel Ms Radha Mishra appointed for non-applicant No.2 is absent.

Learned counsel Shri M.V.Rai for applicants, submits that during pendency of proceedings Investigating Officer filed chargesheet against applicants. He, therefore, prays for withdrawal of this application with liberty to applicants to file an application under Section 482 of the Code of Criminal Procedure for quashing of the chargesheet. .....2/-

The criminal application stands disposed of as withdrawn with liberty to applicants to file fresh application under Section 482 of the Code of Criminal Procedure to challenge the chargesheet.

It is made clear that case of applicants was not heard by this Court on its own merits.

Though learned counsel Ms Radha Mishra appointed for non-applicant No.2 is absent, it appears that she has filed reply on behalf of non-applicant No.2. The High Court Legal Services Sub Committee at Nagpur is directed to pay Rs.500/- to learned counsel Ms Radha Mishra towards expenses.
