Motwani, learned counsel for the petitioner on instructions submits that during pendency of the proceedings due to the policy decision taken by the State of Maharashtra and especially the Government Resolution dated 28/06/2017, the cause for prosecuting the present writ petition does not survive. He submitted that it is the petitioner who has infact made an excess payment to the respondent No.4 Society and has to recover the same from it.

In view of the aforesaid, the writ petition is disposed of. The petitioner is at liberty to take such steps as are permissible to recover any amount if the same is due.
