DATE : 21st MARCH 2022 By this application, the applicant is seeking to bring her name on record as the legal representative of the petitioner. It is stated that the petitioner expired on 05/09/2021, after filing of the present writ petition.

For the reasons stated in the application, the same is allowed and the applicant is permitted to be brought on record as legal representative of the petitioner.

Mr. Bhoot, learned counsel appearing for the petitioner submits that in the present case the appellate authority could not have condoned the delay, since admittedly the delay in filing the appeal on the part of the respondent No.1 was beyond the period of 120 days. This contention is raised with reference to Section 7(7) of the Payment of Gratuity Act, 1972.

Issue notice to the respondents for final disposal, returnable on 19th April 2022.
