IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR.
WRIT PETITION NO. 1501/2015.
Shri Shankarrao Bhagwanji Vyawahare and others. -VERSUSState of Maharashtra and others.
Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders or directions and Registrar's orders.
CORAM : B.P. DHARMADHIKARI & KUM. INDIRA JAIN, JJ.
DATE : AUGUST 01, 2016.
Heard Shri N.B. Bargat, learned Counsel for the petitioners, Shri N.S. Rao, learned A.G.P. for respondent nos. 1 to 3 and Shri D.M. Kakani, learned Counsel for respondent no.4.
2.
Orders of this Court dated 07.03.2016 contained a direction to respondent no.4 to forward necessary proposal within a period of four weeks. As the proposal was already sent, respondent no.4 has not forwarded any fresh proposal. Petitioners also have not made any grievance about it, though a period of more than four months had already expired.
3.
During hearing we find that prayer of petitioners is to direct respondent nos. 1 to 3 to consider the proposal already sent by respondent no.4 and to approve it so that petitioners can be given benefit of 5th and 6th Wage Revision.
4.
In this situation, we direct respondent no.4 to submit appropriate proposal once again to respondent no.1 within a period of six weeks from today without fail.
5.
The respondent no.1 shall after receipt of such proposal, process it as per law within next four months. If necessary an opportunity of hearing may be extended to the parties. With these directions and keeping all rival contentions open, we partly allow and dispose of the Writ petition. No costs.
