Pointing out the provisions under Rule 19 of The Prisons (Bombay Furlough and Parole) Rules, 1959, learned Counsel appearing for the parties submit that the said provision regarding grant of parole leave may not have application in relation to illness of the petitioner himself. Learned counsel for the petitioner, therefore, seeks leave to withdraw the writ petition with liberty to file appropriate application for grant of furlough leave before the

The writ petition is disposed of as withdrawn with liberty as prayed for.

Learned counsel for the petitioner shall pay the costs of Rs.500/- (Rupees Five Hundred Only) to the High Legal Services Sub Committee, Nagpur.
