DATED : 09/09/2019 Today, I have dismissed Writ Petition No. 2699/2019 and have maintained the orders passed by the subordinate authorities disqualifying the petitioner under Section 14 (1) (j-3) of the Maharashtra Village Panchayats Act on the ground that the petitioner is residing in house constructed on government / gram panchayat land. In this petition, the orders passed by the subordinate authorities disqualifying the petitioner under Section 14 (1) (j-3) of the Act of 1958 for encroaching over the government / village panchayat land/road are challenged. In view of the fact that disqualification of the petitioner is upheld in Writ Petition No. 2699/2019, the challenges in this petition have become academic. Hence, without delving into the issues raised in this petition, the petition is dismissed as infructuous. In the circumstances, the parties to bear their own costs.
