Prayer is made on behalf of the appellant seeking leave of this Court to file Appeal to challenge the judgment passed by the learned Judicial Magistrate, First Class, Yavatmal, dismissing its complaint under section 138 of the Negotiable Instruments Act. On perusal of the judgment and order and the issue involved in the Appeal, I am of the opinion that it would require a detailed consideration by this Court and for that purpose it is necessary to grant leave to file Appeal.
In these circumstances, leave is granted. The application is allowed.
