The petitioner has approached this Court being aggrieved by the inaction on the part of Scrutiny Committee in not deciding the claim of the petitioner and thereby endangering the admission of the petitioner to the Engineering course in the respondent no.3 college.

It is not in the hands of the petitioner as to within how much time the respondent Scrutiny Committee shall decide his claim. However, the petitioner cannot be penalized for inaction on the part of respondent Scrutiny Committee. In any case, it is to be noted that the petitioner's father has already been granted validity.

In that view of the matter, the respondent no.1 Scrutiny Committee is directed to decide the caste claim of the petitioner as expeditiously as possible and in any case within a period of six months from today.

It is directed that till the decision of the petitioner's

16.7WP.1334.15 claim, the respondent no.3 shall not disturb the admission of the petitioner to the Engineering course and respondent nos. 2 & 3 are directed to permit the petitioner to appear in the examination and declare the result of the petitioner and if successful permit him to prosecute further studies. It is further directed that in the event the decision of the respondent Scrutiny Committee is adverse to the interest of petitioner, the same shall not be given effect to for the period of three weeks from the date of communication of the order to the petitioner.

The Writ Petition stands disposed of accordingly. Judge Judge J.
