Thereafter on 5-7-2024, yet another order was passed, which reads thus ;

"The learned Counsel for Petitioner submits that the Petitioner is interested in prosecuting the Petition.

List the Petition in the week commencing from 5th August, 2024.

It is made clear that no more adjournment will be granted."

As could be seen, learned counsel for the petitioner submitted that the petitioner is interested in prosecuting the petition. It was made clear that no more adjournment will be granted. Despite such status, none appeared for the petitioner. It appears that the petitioner is not interested in prosecuting the petition. Petition is accordingly dismissed with costs of Rs. 5,000/- to be paid to other side.

If the application to restore the petition is filed, the same shall be listed before the Court only upon payment of costs, which shall be condition precedent for listing the application before the Court.
