DATE : July 10, 2018 By this application it is prayed that the decree passed by the trial Court and maintained by the appellate Court directing the appellant to hand over possession of 0.11R land be stayed during pendency of the appeal. It is stated that during pendency of the appeal before the District Court also said decree was stayed. Notice was issued on the Civil Application on 09/01/2018 and parties were directed to maintain status quo until further orders. No reply has been filed to the aforesaid application. As the appeal has been admitted and the decree is for delivery of possession, its execution in so far as prayer for possession is concerned stands stayed. The applicant shall not create any third party rights in the suit property. Civil Application is allowed and disposed of. JUDGE Asmita
