Shri Palshikar, the learned Counsel for the appellant submits that connected First Appeal No.701/2015 has already been admitted by this Court on 23rd November, 2015.

In view of above, the present appeal is admitted. Mrs. Geeta Tiwari, learned A.G.P waives service for respondent Nos.2 and 3.

Respondent No. 1 be served by R.P.A.D. in addition to regular mode of service.

Call for record and proceedings.

Put up along with First Appeal No.701 of 2015. Civil Application [CAF] No.2948/2015 :- Heard.

There shall be stay in terms of prayer clause of the

fa.1033.15 2/2 civil application, which shall continue to operate pending the decision of appeal. The appellant to deposit entire decretal amount in this Court within a period of twelve weeks from today, failing which, the civil application shall stand dismissed without further reference to this Court.

The civil application stands disposed of.
