DATED : 21-09-2016 First Appeal No.716 of 1996 was filed before this Court by the Union of India (respondent No.3 in this appeal) challenging the same award, which is challenged in the present appeal. First Appeal No.716 of 1996 is allowed, the award passed by the reference Court is set aside and the matter is remitted to the reference Court for deciding the reference afresh.

In view of the judgment given in First Appeal No.716 of 1996 on 21-09-2016, the appellant (original claimant) seeks permission to withdraw the appeal with liberty to raise appropriate challenges, if required, after the reference is decided.

The appeal is disposed as withdrawn with liberty as prayed for.
