CORAM: ROHIT B. DEO, J.
DATE: 3 rd MARCH, 2020.
Heard the learned Senior Counsel Shri Anil Mardikar for the applicant.
2] Issue notice.
3] Shri S.M. Ghodeswar, the learned APP waives service for non-applicant/State.
4] Shri Ghodeswar, the learned APP fairly states that the Investigating Officer Shri Ishwar Chavan has informed him that in view of the fact that the applicant is suffering from cancer, the prosecution has no objection if she is released on bail.
5] Even de hors the statement fairly made, in my considered view, the applicant has made out a case for
ba200.20.O.odt grant of bail. She is in custody in connection with offence punishable under Section 7, 7(a) of the Prevention of Corruption Act. She has been custodially interrogated and no purpose shall be served by continuing her incarceration. This apart, she is suffering from cancer which in itself is a good ground for releasing her on bail. The application is allowed subject to the applicant furnishing personal bond of 25,000/- and a surety of like amount.
6] The applicant shall report at the office of the Anti Corruption Bureau, Akola as and when directed by the Investigating Officer, in writing.
