Issue notice to the non-applicant/State.

Shri A.V. Palshikar, learned A.P.P. waives notice for the State and files on record the reply of the prosecution. On going through the copy of F.I.R. available on record and the reply of the prosecution, it is seen that the age of the prosecutrix was of about 16 years and that is the reason why an offence under Section 8 of the Protection of Children from Sexual Offences Act has also been registered against the applicant.

Considering the age of the prosecutrix and the stricter provisions of law, I do not think that this is a fit case for grant of anticipatory bail.

The application stands rejected.
