With the consent of the parties, the impugned order dated 14/12/2021, passed by the respondent No.2 - Tahsildar in Revenue Case No.LND-31/Dahikhel-Futkar/20212022 is quashed and set aside. The matter is remanded to the learned Tahsildar to decide the preliminary objection afresh by hearing the parties. The respondent No.2 - Tahsildar is directed to pass speaking order while deciding the preliminary objection.

The parties to appear before the respondent No.2Tahsildar on 05/01/2026. Parties to note that separate notice for appearance will not be issued.

Writ Petition is partly allowed and disposed of accordingly. No order as to costs.
