Respondent nos. 1 to 6 seek withdrawal of the amount of compensation deposited by the appellant.

Perused the judgment of the Reference Court. It is seen that an amount of Rs. 3500/- for each orange tree has been granted. Considering the fact that the Land Acquisition Officer had granted an amount of Rs. 3450/- for orange trees the following order is passed:

The respondent nos. 1 to 6 are permitted to withdraw 75% of the amount deposited subject to filing an undertaking in this Court that in case the appeal is allowed the amount withdrawn shall be repaid with interest at such rate the Court may direct. The remaining amount is permitted to be withdrawn on furnishing solvent surety to the satisfaction of the Registrar (Judicial). Civil application is disposed of. JUDGE svk
