Heard Shri Abhijit Parihar, Advocate for the appellant, Shri S.D. Chopde, Advocate for respondent Nos.1 and 2 and Shri M.A. Kadu, A.G.P. for respondent Nos.3 to 5. As the amount is deposited by the appellant, the interim order granted on 22nd July, 2016 shall continue till the disposal of appeal.

Considering the facts of the case, the respondent Nos.1 and 2/claimants are permitted to withdraw Rs.4,00,000/-. The amount be given to the respondent Nos.1 and 2/claimants in equal proportion. The balance amount be kept in fixed deposit in nationalized bank till the disposal of appeal. The civil applications are allowed in the above terms. No costs.
