It is the case of the petitioners that vide judgment and order dated 28.06.2022 in Writ Petition No.3128/2006, the relief came to be conferred on the petitioners by quashing the order dated 06.09.2021 of appointment to the post of Multi-Purpose Health Worker (Male).

Accordingly, the petitioners came to be granted benefit vide order dated 27.07.2022.

It is the case of the petitioners that in view of the fact that the petitioners having rendered continuous Corrected as per Court's order dated 05.05.2025.

service from 2011 i.e. the date on which there was a clear vacancy available with the respondents, the benefits are not conferred to these petitioners.

That being so, we deem it appropriate to dispose of the petition by directing the respondent Nos.1 to 3 to decide the claim of the petitioners for grant of benefits in accordance with prayer clause - 1 in the light of the

2 107.wp.1845.25.corrt.1 submission that the vacancy against which the petitioners were granted relief vide order in Writ Petition No.3128/2006 was available since 2011.

Corrected as per Court's order dated 09.05.2025.

Let the decision be communicated to the petitioners within four months from today.

Order accordingly. No costs.
