Heard the learned counsel for the applicant on the application for condonation of delay as well as on the prayer for review of the judgment dated 16th and 17th December, 2015.

It is submitted by relying upon the decision in Asia Foundation and construction Ltd. Nagpur and Anr. vs. Engineering Kamgar Sanghatana Nagpur and Anr. 2016 (2) Mh.L.J. 406 that the contentions that were urged on behalf of the present applicant in the aforesaid writ petition are liable to be accepted. The said judgment of the Division Bench is dated 18th December 2015 which is subsequent to the decision in the present writ petition. A decision rendered subsequently would not be a ground to review an order passed earlier.

I do not find any error apparent in the judgment of which review is sought. Hence the applications are rejected. JUDGE Asmita
