The applicant is apprehending arrest in Crime 1238/2020 registered with Police Station, Ramnagar, Tahsil and District Chandrapur for offence punishable under Section 420 of the Indian Penal Code.

The gist of the report on the basis of which the crime is registered is that the applicant induced the informant to part with 3,20,000/- on the basis of an θ╕ agreement to purchase certain land and it has transpired that the persons who are the owners of the land are already dead.

Mr. Vyas, the learned counsel for the applicant submits that the dispute is civil in nature and the amount of 3,20,000/- allegedly paid by the informant is θ╕ already returned, without prejudice to the contentions of the applicant-accused.

Learned Additional Public Prosecutor Mrs. K. R. Deshpande fairly states that her instructions are that the amount is indeed repaid to the informant.

In any event, considering the nature of accusations, the custodial interrogation is not required. Interim pre-arrest protection granted vide order dated 17-3-2021 is made absolute with the only modification that till the filing of the charge-sheet, the applicant shall attend the concerned police station as and when required by the Investigating Officer.

The application is disposed of.
